WHEREASThe Weed Control Act (the “Act”) and Regulations govern the prevention of the spread of noxious or nuisance weeds;

 

WHEREAS the Act requires any owner or occupant of land within a municipality to comply with orders of a Weed Inspector to eradicate, contain, and/or control prohibited, noxious or nuisance weeds respecting the owner’s land or the land on which the person is an occupant;

 

 WHEREAS The Weed Control Act deems a municipality to be the owner of all streets, lanes, public highways, road allowances, bridges, alleys, squares or thoroughfares intended for or used by the general public for the passage of vehicles or pedestrians within its boundaries;

 

WHEREAS the Act, therefore, removes Provincial responsibility for the control of weeds in the right of ways belonging to Her Majesty the Queen under the maintenance of Saskatchewan Ministry of Highways and Infrastructure;

 

BE IT RESOLVED that SARM lobby the Provincial Government to update The Weed Control Act to move responsibility for the control of weeds on provincial highways from the municipality in which they are located to the Province.
