WHEREAS oil and other companies have an appeal mechanism in place to which they can appeal the municipality’s required installation depth of pipe or any other underground facility to be installed to the Ministry of Highways and Infrastructure. The Ministry may then overrule the municipality’s depth and allow the pipe or any other underground facility to be installed at the provincially recognized depth;
WHEREAS municipalities do not have an appeal mechanism in place to try to explain the importance of the deeper depth of installation;
BE IT RESOLVED that SARM lobby the provincial government to put in place an appeal mechanism for any party involved to appeal to a separate and impartial agency.

The Ministry of Highways, through The Highways and Transportation Act, 1997, has a mechanism in place which provides parties involved, including local governments, the opportunity to outline their concerns and explain why a deviation from the accepted standard is required.
