Resolution 17-02A 

WHEREAS, section 254.1 of The Urban Municipality Act and section 307.4 of The Rural Municipality Act, 1989 provide that where someone appeals their assessment to the Board of Revision, the party appealing, SAMA, and the municipality can sign an agreement to resolve an appeal; and 

WHEREAS, once this agreement is in place, the Board of Revision need not be further involved and no further expenses of dealing with the appeal need be incurred;

THEREFORE BE IT RESOLVED, that the legislation be amended by removing the requirement for the Board of Revision to confirm assessment agreements, and that the agreed upon valuation or classification becomes legal and binding for the current year. 

Response From the Hon. Ron Osika:

GR would not be in favour of the proposed amendment.

Having the Board of Revision independently confirm the validity of an assessment agreement is an important element of the process and ensures that the public interest is protected. The Board of Revision is also responsible for enduring the agreement is appropriate in the context of assessments for similar properties.
