WHEREAS the purchase of a right-of-way is required for road construction projects on MREP and CTP roads to meet the construction standards; and

WHEREAS the right-of-way purchase is a direct cost of the road construction project and is not an eligible expenditure;

BE IT RESOLVED that the cost of right-of-way purchases for MREP and CTP roads be an eligible construction expenditure;

BE IT FURTHER RESOLVED that the maximum claimable compensation be set by the program administrators whereby a multiple can be applied to the assessed value of land or any other criteria that is able to provide the landowner a reasonable level of compensation.
