Resolution No. 6-03M

WHEREAS, Section 251 of The Rural Municipality Act, 1989, stipulates the required notice relating to derelict vehicles must be by personal service if the owner or occupant resides in the municipality; and

WHEREAS, Sections 249 and 250 of the same Act related to nuisances and untidy and unsightly premises, give municipalities the option of serving the required notice either personally or by registered mail regardless of residence;

THEREFORE BE IT RESOLVED, that the Province be requested to amend Section 251 of The Rural Municipality Act, 1989, to permit service of the required notice either personally or by registered mail.

Response From Honourable Len Taylor, Minister of Government Relations:

The department will consider this request when reviewing potential amendments to The Rural Municipality Act, 1989 (RMA). A number of options can be considered to accommodate the intent of this resolution including providing municipalities the authority to mail the notice to affected individuals or port the notice on the affected vehicle. This would be consistent with the authority provided to urban municipalities. The department will consult with SARM when this matter is considered.
