WHEREAS with the creation of the New West Partnership Trade Agreement it has created the necessity for municipalities to tender for equipment, construction and various goods and supplies, as per Section 184 of The Municipalities Act requiring that municipalities comply with trade agreements; and

 

WHEREAS the competitive bidding process is legally binding between municipalities and the supplier of goods and services; and

 

WHEREAS the responsibility to create a legal tender that meets and protects the needs of the municipality falls onto council members and administrative staff who do not have the expertise;

 

BE IT RESOLVED that SARM’s Legal Department create tender package templates for various projects as a guide for rural municipalities.
